What is probate?

Probate is a largely administrative legal process for obtaining an “estate grant”, which is a court document that gives an executor the authority to transfer / deal with assets that are in the name of the deceased so that the estate can go to the beneficiaries.

The probate process includes:

  1. working with an executor to ensure that the deceased’s last will is identified,
  2. obtaining information from the executor and others to complete notices to be issued to beneficiaries as well as those who would receive the benefit of the estate had their not been a will,
  3. obtaining information from the executor and others to complete and file appropriate forms with the court system, and
  4. making court applications as might be necessary to deal with irregularities.
