I’m hanging up my keyboard. At least for now. Perhaps when my work week is shaved down and I regain a writing passion I’ll want to return. And perhaps there will still be a media platform willing to publish what I’ve got to say.
The most common deterrent for beach of Charter rights is exclusion of evidence. Criminal law databases are full of cases where the police have successfully caught a bad guy, but the case has been thrown out because they got their hands on the incriminating evidence by trampling on the bad guy’s rights.
An unlawful arrest is a breach of your right under section 9 of the Charter “not to be arbitrarily detained or imprisoned”.
But might you be perfectly within your rights to keep walking? And might it be lawful to resist an arrest? What then? Do you have any recourse against the police?
We know that we have a racism problem in Canada. A problem that our Prime Minster has acknowledged permeates every institution, including the police. I am not intending to distract us from that important focus. But what about a police brutality problem?

Conveniently, keeping your dog under control doesn’t just achieve public safety. It’s the polite thing to do.
Dog attacks, where one dog attacks another while on a walk with their owners, would not occur if dog owners followed basic dog walking etiquette.
The outdated law does not hold a dog owner accountable unless the victim can prove that the owner was aware of the dangerous disposition of their particular pet.
The large dog attacked again when Mr. Belleville went to investigate. It slipped out of its collar and sunk its teeth into Mr. Belleville’s arm.
And it dies with the injured victim, even if they had already endured years of “pain and suffering” before passing away.
